Please read these Terms and Conditions and Privacy Policies carefully before using this mobile application (Translation Technology). By using the App you agree to abide by the Terms and Conditions as well as the Policies set out.
Your access to and use of the App is conditioned to your acceptance of and compliance with all the Terms and Conditions as well as Policies. These Terms and Conditions as well as Policies apply to all students, teachers, users and others who access or use the App. By accessing or using the App, you agree to be bounded by all these the Terms and Conditions as well as Policies. If you do not agree, you should stop using the App immediately.
The following terminology applies to these Privacy Policies and Terms and Conditions: "You" and "Your" refers to you, the person log on to this App. "Translation Technology ", "Ourselves", "We", "Our" and "Us", refers to the App, the Project Team and/or HKMU. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.
We reserve the right to modify or replace the Terms and Conditions as well as Policies at our sole discretion any time. You are advised to read the Terms and Conditions as well as Policies regularly. We may change or revise the Terms and Conditions and Policies from time to time, where appropriate. We reserve the right to take appropriate action under its relevant policies and procedures where breaches occur. These actions are subject to the sole discretion and final determination by us and users shall raise no objection therein.
Terms and Conditions
These terms and conditions outline the rules and regulations for the use of the mobile App (Translation Technology).
Terms of Use
Please read these Terms of Use carefully. By accessing to this App, you are consenting to the Terms of Use.
This App (Translation Technology) is designed and developed for learning, teaching and research purposes. Users are restricted to use this App inside the classroom and/or in teaching and learning contexts. Due to the copy-right issues, the virtual reality (VR) and non-VR practice/tasks can only be used during the lectures and tutorials within the campuses of HKMU. You must be 18 years of age or older to use the APP.
Account
You need an account for most activities on our platform. Keep your password somewhere safe, because you are responsible for all activities associated with your account.
You have complete responsibility for your account and everything that happens on your account, including any harm or damage (to us or anyone else) caused by someone using your account without your permission. This means you need to be careful with your password. You may not transfer your account to someone else or use someone else’s account. If you contact us to request access to an account, we will not grant you such access unless you can provide us with the information that we need to prove you are the owner of that account.
Content and Behaviour Rules
You may not access or use this App for unlawful and commercial purposes. Your use of this App and behaviour on our platform must comply with applicable local or national laws or regulations of Hong Kong Special Administrative Region (HKSAR). You are solely responsible for the knowledge of and compliance with such laws and regulations that are applicable to you.
We may terminate or suspend your permission to use this App or ban your account at any time, with or without notice, for any or no reason, including for any violation of these Terms, if we suspect that you engage in fraudulent or illegal activities, or for any other reason in our sole discretion. Upon any such termination, we may delete your account and content, and we may prevent you from further access to this App or use of this App. Your content may still be available on the platforms even if your account is terminated or suspended. You agree that we will have no liability to you or any third party for termination of your account, removal of your content, or blocking of your access to our platforms and services.
Submission of Comments
The following describes the terms and conditions applicable to your use of the “Comment” submission services (including, but not limited to upload/post/share anything to the APP).
You must be 18 years old or over to submit a “Comment” or upload/share anything to the APP.
We have the right, but not the obligation, to take any of the following actions, in our sole unfettered discretion, at any time, and for any reason or no reason, without providing any prior notice:
a. Restrict, suspend or terminate your ability to submit “Comments,” or any other content, to the App;
b. Change, suspend or modify all or any part of the App or the features thereof;
c. Refuse or remove any material posted on, submitted to or communicated through the App by you;
d. Deactivate or delete any screen names, profiles or other information associated with you; or
e. Alter, modify, discontinue or remove any content of the App.
You agree that, when using or accessing the App or any of the features thereof, you will not:
a. Violate any applicable law or regulation;
b. Interfere with or damage the App;
c. Transmit or introduce to the App or to other users thereof any viruses, cancel bots, Trojan horses, flood pings, denial of service attacks, or any other harmful code or processes;
d. Infringe the rights of any third party, including but not limited to any intellectual property rights, privacy rights, publicity rights or contractual rights;
e. Transmit or submit harmful, threatening, abusive, harassing, defamatory, deceptive, fraudulent, obscene, indecent, vulgar, lewd, violent, hateful or otherwise objectionable content or material;
f. Transmit or submit any unsolicited advertising, promotional materials, or spam;
g. Stalk or harass any user or visitor to the App; or
h. Use the content or information available on the App for any improper purpose.
You retain the Copyright in any “Comment” you submit to us. By submitting a “Comment” to us, you agree to grant us an irrevocable, non-exclusive, royalty-free, perpetual license to use the material or commentary that you have submitted, in any medium and in any manner that we may, in its sole unfettered discretion, choose.
By submitting a “Comment” to the App, you agree to comply with the following rules concerning such submissions:
a. You agree not to include in your “Comment”:
i) Any false, defamatory, libellous, abusive, threatening, racially offensive, sexually explicit, obscene, harmful, vulgar, hateful, illegal, or otherwise objectionable content;
ii) Any content that may be harassing any other App contributors or other third parties;
iii) Any content that personally attacks an individual whose identity can be easily learned from what you post (An example of a personal attack is posting negative comments about an individual in a way meant to demean that person. Note that posting your opinion about someone’s ideas or actions is not a personal attack);
iv) Any content that discloses private or personal matters concerning any person;
v) Any content that you know to be false, misleading, or fraudulent;
vi) Any content that violates the property rights of others, including unauthorized copyrighted music, images or programs, trade secrets or other confidential or proprietary information, and trademarks or service marks used in an infringing fashion;
vii) Any use of profanity;
viii) Any content including advertisements or otherwise focused on the promotion of commercial events or businesses, or any request for or solicitation of money, goods, or services for private gain;
ix) Any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
x) Any content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or
xi) Any content directly or indirectly soliciting responses from minors (defined as anyone under 18 years of age).
b. You assert that the information, pictures, music and other files you contribute are your own, are licensed to be uploaded and downloaded by other participants, are in the public domain, or are otherwise free of copyright or other restrictions. If any part of the “Comment” is not your original work, it is your responsibility to obtain permission from the copyright owner before making that “Comment” available on the App.
c. You are solely responsible for “Comment” you upload, post, transmit or otherwise make available to others using this App. Under no circumstances will we be liable in any way for any “Comment” posted on or made available through this App by you or any third party.
d. You understand that we do not generally pre-screen “Comments” posted on or available through the App by individual authors and that it has no obligation to do so. The App and its designees have the right (but not the obligation) in their sole unfettered discretion to remove any “Comment” that is posted on or available through the App. Without limiting the foregoing, The App and its designees will have the right to remove any “Comment” that violates these Terms or is otherwise deemed objectionable by us in its sole discretion.
We respect the intellectual property rights of others, and under appropriate circumstances will terminate access to the “Comments” feature of the App by users who infringe the copyrights of third parties. If you believe that the copyright in your work has been infringed on the App, please provide written notice of your claim of copyright infringement to us.
Rights to contents you post
When you post content, comments, questions, reviews, and when you submit to us ideas and suggestions for new features or improvements, you authorize us to use and share this content with anyone, distribute it and promote it on any platform and in any media, and to make modifications or edits to it as we see fit.
By submitting or posting content and comments on or through this App, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your content (including your name and image) in any and all media or distribution methods (existing now or later developed). This includes making your content available to other organizations, or individuals who partner with us for the syndication, broadcast, distribution, or publication of content on other media, as well as using your content for marketing and academic purposes. You also waive any rights of privacy, publicity, or other rights of a similar nature applicable to all these uses, to the extent permissible under applicable law. You represent and warrant that you have all the rights, power, and authority necessary to authorize us to use any content that you submit. You also agree to all such uses of your content with no compensation paid to you.
Intellectual Property Rights and Copyright
All intellectual property rights on this App, unless otherwise acknowledged, belong to us. All rights under applicable laws are hereby reserved. Except with our written permission, you are not allowed to upload, post, publish, reproduce, transmit, edit, or distribute in any way any part of this App. Without our official written permission, you are NOT allowed to use any part of this App in any way for research, academic, publication and/or commercial purposes. Any reproduction, adaption, distribution, dissemination or making available of such copyright works to the public is strictly prohibited.
Permission is granted for users to download the specific materials herein to store them in smartphones or other mobile devices and/or local computers, provided that this is solely for personal and non-commercial internal use.
The contents (images, texts, graphics, logos, video, and all other materials) published on this App are the property of the Project Team and/or its content creators. The entire compilation of the contents found on the App is the exclusive property of the Project Team who has the authorship and owns the copyright of such contents.
Links in the App
The links in this App may take you to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the contents, privacy policies, or practices of any third-party websites or services. References and links to any such sites shall not be taken as an endorsement by our opinions expressed or services provided at those sites.
You acknowledge and agree that we shall not be responsible or indirectly, caused or alleged to be caused in connection with the use of or reliance on any such contents, goods or services available on through any such websites or services.
Privacy Policy
Consent for accessing user records and information
Before you start using the App, we advise you to read our Terms and Conditions as well as Privacy Policy carefully. It will help you better understand our practices.
Our App grants us the right of access to viewing users’ records as well as collecting and using information related to the individuals using the App (including but not limited to their usage records, names, email addresses, online messages, tests, surveys, exercises and recordings). The Project Team will maintain the confidentiality of user records, and will only access data through the Project Team, as well as via the App.
We use your personal data mainly for improving the App as well as for teaching, learning, and research purposes. We may collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-confidential data for teaching, learning and research purposes. Data may be used to understand how users use the App. This could include collecting and analysing usage statistics, that is, information pertaining to the pages of the App that you visit, the time, duration and data of your visit, together with other statistics. Such information may be used to customize, improve or update the App. All the comments made (including those deleted) may be collected and used. By using the App, you agree to our collection and use of such information in accordance with the Policies as well as Terms and Conditions.
We respect personal data and are committed to full implementation and compliance with the data protection principles and all relevant provisions of the Hong Kong Personal Data (Privacy) Ordinance.
The personal data we collect will be used for processing account set up, contacts, research, statistical purposes, marketing, and prescribed purposes as allowed by the law from time to time. We will divulge personal information only if required by law or with your prior consent. However, data may also be used in aggregate form for research and statistical purposes and in such circumstances individual data will not be divulged.
The personal data that you supply might be used for communication, research, and statistical purposes.
Personal data might be collected through the App from users, such as:
• Personal information, such as the name and the email address
• Programme(s) or course(s) enrolled
• Content that users create or post through his /her account
• Use of Cookies
• Log files and users’ log data
• Comments or anything posted on the App
• Exercises practiced via the App
• Data of questionnaire(s) and test(s)
We reserve the right to update or change our Privacy Policy at any time as we think fit, and you should check these Privacy Policies periodically. You acknowledge these modifications and your consent to abide and be bound by the modified Privacy Policy.
Disclaimer
Content of the App is made at such times as our Project Team determines at the discretion. You should not assume that the information contained in our App has been updated or otherwise contains current information. Our team may not review users’ postings to determine whether they are accurate, and information contained in such postings may have been superseded. The information and materials in our App are provided for your review in accordance with the notices, terms and conditions set forth herein.
The contents of this App are for general reference only and may be amended or removed at any time without prior notice. These materials are not guaranteed or represented to be complete, correct or up to date. We do not guarantee that they are free of defects, errors and omissions, and we assume no responsibility whatsoever in respect of them.
Whilst we endeavour to ensure the accuracy of this general information, no statement, representation, warranty or guarantee, express or implied, is given as to its accuracy or appropriateness for use if any particular circumstances.
This App also contains information contributed by others over whom, and in respect of which, we may have no influence. Users may link from this App to sites provided by others. We are not responsible for any loss or damage whatsoever arising out of or in connection with any information including data or programmes on this App. We reserve the right to omit, suspend or edit all information in the App at any time in its absolute discretion without prior notice. Access to this App may be suspended temporarily and without notice in circumstances of system failure, maintenance or repair or for reasons beyond our control.
We do not accept any responsibility for any direct or indirect loss or damage arising from any cause of use in connection with this App. You acknowledge and agree that the Project Team and the University shall not be responsible nor liable for any damage or loss, directly or indirectly, caused or alleged to be caused in connection with the use of or reliance on any such content, goods, or services available or through any such website or the App.
You expressly agree that the use of the App is at your sole risk. Neither we,our affiliates, nor any of their respective employees, agents or licensors warrant that the App will be uninterrupted, timely, secure or error free.
This disclaimer of liability applies to any damages or injury caused by any failure or performance, error, omission, interpretation, deletion, defect, deletion, communication line failure, theft or destruction or unauthorized access to, alteration of or use, whether for breach of contract, tortious behaviour, negligence and agree that we shall not be liable for the defamatory, offensive or illegal conduct of users of the App or third parties, and the risk of injury from the foregoing rests entirely with users/subscribers.
In no event will us, or affiliates or any of their respective employees, agents or licensors be liable for any damages, including without limitation direct, incidental, special, consequential or punitive damages, arising from, relating to or connected with the use or inability connected with the App or these terms.
